1. Overview

AI Error Hub respects the intellectual property rights of others and expects users to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA") of 1998, we respond to notices of alleged copyright infringement on our website that comply with applicable law.

If you believe that content on AI Error Hub infringes your copyright, please follow the procedures below to submit a formal DMCA takedown notice. We take copyright complaints seriously and respond promptly to valid notices.

Before Filing a DMCA Notice

If you believe the issue can be resolved without a formal DMCA process, please email us at info@aierrorhub.com with subject "Copyright Concern." Many issues can be resolved quickly through direct communication.

2. Submitting a DMCA Takedown Notice

To submit a DMCA takedown notice, you must send us a written communication that meets the requirements of 17 U.S.C. § 512(c)(3). Your notice must contain the specific elements listed in the next section.

3. Required Information

Your DMCA notice must include ALL of the following elements to be legally valid under 17 U.S.C. § 512(c)(3):

Legally Required Elements

  1. Physical or electronic signature A physical or electronic signature of the person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed. Typing your full name at the end of the email is acceptable as an electronic signature.
  2. Identification of the copyrighted work Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  3. Identification of the infringing material Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material — specifically, the exact URL(s) on aierrorhub.com where the alleged infringement appears.
  4. Contact information Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and (if available) an electronic mail address at which the complaining party may be contacted.
  5. Good faith statement A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. Accuracy and authority statement A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Incomplete Notices

DMCA notices missing any required element may not be considered legally valid and may be rejected or delayed while we request additional information. We recommend consulting an attorney if you are unfamiliar with DMCA procedures.

4. Designated Copyright Agent

5. Our Process After Receiving a Notice

Upon receipt of a valid DMCA takedown notice, here's what happens:

Initial Review (within 3 business days) We review the notice for completeness and validity under 17 U.S.C. § 512(c)(3).

Content Removal (if valid) If the notice is valid, we remove or disable access to the allegedly infringing material expeditiously (typically within 24 hours of validation).

Uploader Notification We notify the user who submitted the content (if applicable) that their content has been removed and provide them with a copy of the DMCA notice.

Counter-Notice Window The uploader has the right to submit a counter-notice. If received and valid, we may restore the content after 10-14 business days unless the original complainant files legal action.

Documentation We maintain records of all DMCA notices, actions taken, and communications for our safe harbor compliance.

6. Counter-Notice Procedure

If you believe that content of yours was removed or disabled by mistake or misidentification, you may file a counter-notice with us. A valid counter-notice must include:

  1. Your physical or electronic signature
  2. Identification of the removed material and the location at which the material appeared before it was removed (specific URL)
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  4. Your name, address, and telephone number
  5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the U.S., that you consent to the jurisdiction of any judicial district in which we may be found), and that you will accept service of process from the person who provided the original DMCA notification

7. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, AI Error Hub has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers.

Specifically:

  • First offense: Content removed, warning issued to the user (if applicable)
  • Second offense: Temporary suspension of contribution privileges
  • Third offense: Permanent termination of contribution privileges and account access

Note: As AI Error Hub content is primarily produced by our editorial team (not user-submitted), this policy applies mainly to comment sections, GitHub contributions, and community-submitted error reports.

8. False Claims Warning

⚠️ Warning About False DMCA Claims

Section 512(f) of the DMCA imposes liability on any person who knowingly materially misrepresents that material is infringing. Submitting a false DMCA notice can result in significant legal liability, including damages, attorney fees, and other costs. Only submit a DMCA notice if you are the copyright owner or authorized to act on the copyright owner's behalf, and you have a good faith belief that the material infringes your copyright.

Statements made in DMCA notices are subject to the perjury statement required by law. We may consult legal counsel and take appropriate action against parties who submit fraudulent DMCA notices, including reporting to relevant authorities.

9. Safe Harbor Compliance

AI Error Hub qualifies for the safe harbor provisions of the DMCA (17 U.S.C. § 512). To maintain this status, we:

  • Have designated a copyright agent to receive DMCA notices
  • Respond expeditiously to valid DMCA takedown notices
  • Maintain a repeat infringer policy
  • Do not have actual knowledge of infringing material on our system
  • Do not receive financial benefit directly attributable to infringing activity
  • Comply with standard technical measures used by copyright owners to identify and protect works

10. Alternatives to DMCA Notices

Before submitting a formal DMCA notice, consider whether the issue could be resolved through:

10.2 Fair Use Considerations

Some uses of copyrighted material may qualify as fair use under 17 U.S.C. § 107. Fair use factors include:

  • Purpose and character of the use (commercial vs educational, transformative)
  • Nature of the copyrighted work
  • Amount and substantiality of the portion used
  • Effect on the potential market for the copyrighted work

11. International Copyright Issues
